Building A Patent Portfolio

As your company grows, and your intellectual property policy matures, you will generally focus on two things: developing new inventions to be patented, and continuing to develop existing patent lines.

After a patent is filed but before it issues, you can file subsequent patent applications that contain all or part of the disclosure from a previous application. Using these applications, you can claim inventions that were disclosed, but not claimed, in earlier applications.

If you plan on asserting your patents, keeping these older lines of patents active is important to allow you do tailor your claims to closely match your current products – to provide defensive protection.
