My favorite time to apply for a trademark is once you start selling a product, or offering a service.
By filing after you’re in business you avoid having to submit an “Intent To Use” application, and can get your trademark protection quickly and without extra steps. Doing it early will also help protect you if anyone else with a similar name is a later entrant into your market. By being the first to the Trademark Office you make it easier to protect your mark.
While the first person to use it will usually win in court, the Trademark Office will register the mark of the first person to file.
